Terms of Service

1. Acceptance of Terms

By creating an account or using the WearCrowd platform, you agree to be bound by these Terms of Service. If you do not agree, you may not use WearCrowd. These terms apply to all users, including wearers and brands.

2. Platform Overview

WearCrowd is a marketplace that connects brands ("Brands") with individuals who wear branded merchandise in public ("Wearers"). WearCrowd facilitates connections, manages campaign logistics, and processes payments, but is not a party to any campaign agreement between Brands and Wearers.

3. Eligibility

You must be at least 18 years of age to use WearCrowd. By registering, you represent that all information you provide is accurate and that you have the legal capacity to enter into a binding agreement.

4. Wearer Obligations

  • Wearers agree to wear assigned merchandise in public as specified in campaign briefs.
  • Photo/video proof must be submitted honestly and without alteration.
  • Wearers must not damage, sell, or reassign merchandise received for campaigns.
  • Submitting false or fabricated proof is grounds for immediate account termination and forfeiture of pending earnings.

5. Brand Obligations

  • Brands are expected to honor the payout amount agreed for each campaign.
  • Payment for a campaign is arranged directly between the Brand and WearCrowd once proof is approved.
  • Brands may not request wearers to perform illegal activities, promote harmful content, or misrepresent products.
  • Brands are responsible for ensuring merchandise shipped to wearers is as described in campaign listings.

6. Payments

WearCrowd does not process or hold campaign funds directly. Once proof is approved, the amount owed is recorded on the platform and payment is arranged directly with WearCrowd by contacting us through the contact page. WearCrowd charges a platform fee on completed campaigns (see the Pricing page for current rates).

WearCrowd reserves the right to withhold or reverse a recorded payout in cases of fraud, disputed proof, or violations of these Terms.

7. Prohibited Conduct

You may not use WearCrowd to:

  • Violate any applicable law or regulation.
  • Submit fraudulent proof or engage in sham campaigns.
  • Harass, threaten, or abuse other users.
  • Create multiple accounts to circumvent bans or restrictions.
  • Scrape, crawl, or automate interactions with the platform without permission.

8. Intellectual Property

By submitting proof photos or videos to WearCrowd, you grant WearCrowd and the applicable Brand a non-exclusive, royalty-free license to use that content for marketing and promotional purposes. You retain ownership of your content.

9. Termination

WearCrowd may suspend or terminate your account at any time for violations of these Terms. You may close your account at any time by contacting support. Any payout still owed will be handled according to dispute resolution procedures.

10. Limitation of Liability

WearCrowd is provided "as is." To the maximum extent permitted by law, WearCrowd shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. WearCrowd's total liability is limited to the amounts paid to or by you through the platform in the 3 months preceding the claim.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which WearCrowd Inc. is incorporated, without regard to conflict of law principles. Disputes shall be resolved by binding arbitration, except where prohibited by law.

12. Changes to Terms

We may update these Terms. Continued use of WearCrowd after changes take effect constitutes your acceptance of the updated Terms. We'll provide at least 14 days notice for material changes.
